Employer checklist for DACA and TPS workers
Hiring
- I complete Form I-9 the same way for every new hire
- I let each worker choose their documents from the lists
- I accept documents that reasonably appear genuine
- I do not ask about status or national origin in interviews
- I use E-Verify only after a job offer, if I use it at all
Keeping records
- I keep each Form I-9 in a secure place
- I set a reminder before each work permit's expiration date
- For TPS workers, I check the USCIS TPS page for extensions before acting
Rechecking
- I reverify no later than the expiration date, using Supplement B
- I accept any valid List A or List C document
- I write "EAD EXT" and the date when a TPS card is extended
If a permit lapses
- I talked to an employment attorney about options like unpaid leave
- Final pay is ready on time
- I shared free legal help contacts with the worker
If immigration sends a Notice of Inspection
- I notify employees within 72 hours, in their language
