Claim letter checklist for misclassified workers
Put in your letter:
- Your name, address, phone, and date of birth or claim number
- The business name and address, and the kind of business
- Your start date and, if it ended, your last day
- What you did, where, and who set your hours
- Why you think you were misclassified: 1099, cash pay, no SDI deduction, told you were a contractor
- How each part of the ABC test fits your job
- The dates your proof covers, and why any proof is missing
Attach copies of:
- 1099s, checks, bank deposits or payment app screenshots
- Texts or emails about pay and schedule
- Your own log of dates, hours and pay
- Your Notice of Computation, if you got one
